Business and Technology Case Management Program
The Maryland Court of Appeals established the Business and Technology Case Management Program in the circuit courts by a rule adopted in 2003, now Maryland Rule 16-308. Counsel may seek designation of complex civil cases involving business and/or technology issues to this program by indicating the same on the Civil-Non-Domestic Information Report filed with a complaint or by motion. The Court also may assign cases to the program on its own initiative. Recent amendments to Rule 16-308 provide additional guidance on the types of cases that are and are not presumptively assigned to the program. By delegation from the Administrative Judge, the Program Director determines whether a case is appropriate for assignment to the program.
Cases assigned to the Business and Technology Case Management Program are specially assigned to one of the five judges designated by the Administrative Judge to participate in the program. The assigned judge will conduct a scheduling conference and manage the case to resolution in the circuit court. There are more than fifty opinions on significant issues in business and technology cases available on Lexis, Westlaw, and a statewide judicial website.
The Business and Technology Case Management Program of the Circuit Court for Baltimore City encourages the use of new and established technology in the management and trial of cases. Until the implementation of MDEC in Baltimore City, these resources include the option to use an electronic system for service and maintenance of court papers as a supplement to the official docket and file maintained by the Clerk of the Court.
